Terms of Service

These Terms of Service (“Terms”) govern your access to and use of levelhealth.io and the services provided by Level Health (collectively, the “Services”). By accessing our website, submitting a consultation request, or enrolling as a member, you agree to be bound by these Terms.

Please read these Terms carefully. They include important provisions regarding eligibility, membership fees, refunds, medical disclaimers, dispute resolution, and limitations of liability. If you do not agree to these Terms, do not use our Services.

1. Eligibility

You must be at least 18 years of age and a resident of a U.S. state in which Level Health is currently licensed to practice telemedicine. Level Health is currently licensed in New York, Pennsylvania, and New Jersey. If you reside outside of these states, you may join a waitlist but cannot enroll as a member until licensure in your state is active.

Level Health is a direct-pay, concierge telemedicine practice offering physician-led care including, where clinically indicated:

All consultations are conducted via Spruce, our HIPAA-compliant telemedicine platform. Treatment is provided only when clinically indicated based on physician evaluation. Level Health is not a substitute for emergency care or in-person medical services.

3. Membership and Fees

Level Health offers three membership options, each a 12-month term with two payment alternatives:

Your membership covers the services described on our website at the time of enrollment, including physician visits, lab orders, treatment plan design, and unlimited messaging via Spruce. Recommended therapeutics are billed separately and shipped directly to your door. Therapeutic costs vary based on your personalized, physician-directed treatment plan.

Level Health is a direct-pay, cash-based practice. We do not accept health insurance. Invoices are provided through QuickBooks.

4. Auto-Renewal and Cancellation

All memberships are a 12-month commitment and non-refundable for the duration of the term, whether paid in full at signup or on the payment plan. If you elect the payment plan, the second installment is billed automatically at the six-month mark, and both installments are owed regardless of usage. Your membership may auto-renew at the then-current annual rate. You may cancel auto-renewal at any time up to 30 days before the end of your term by contacting support@levelhealth.io.

In rare cases where baseline bloodwork reveals a medical contraindication to your planned treatment, a prorated refund may be issued at the physician's discretion.

Content on this website and in our communications is for informational purposes and does not constitute medical advice, diagnosis, or treatment. Your physician will discuss all options, expected outcomes, and any relevant risks during your consultation. See our full Medical Disclaimer for additional terms.

In a medical emergency, call 911 or proceed to your nearest emergency room. Do not use Level Health, Spruce messaging, or this website to seek emergency care.

You agree to provide accurate, current, and complete information when interacting with our Services and to keep your contact and clinical information up to date. You agree not to:

All content on this website — including text, logos, graphics, photography, and design — is owned by or licensed to Level Health and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Third-Party Services

Certain features of our Services are provided through third parties, including Spruce (telemedicine platform), QuickBooks (invoicing), therapeutic fulfillment partners, and diagnostic laboratories. Your use of those services is governed by their own terms and policies, which may differ from ours.

9. Limitation of Liability

To the maximum extent permitted by law, Level Health and its affiliates, officers, physicians, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues arising from your use of our Services. Our aggregate liability for any claim relating to the Services is limited to the amounts you paid to Level Health in the twelve (12) months preceding the claim.

Nothing in these Terms limits liability that cannot be limited by law, including for personal injury caused by negligence, fraud, or any other liability that cannot be excluded.

10. Indemnification

You agree to defend, indemnify, and hold harmless Level Health and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Services.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or our Services will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top of this page and, where appropriate, notify you. Your continued use of our Services after updates take effect constitutes acceptance of the revised Terms.
